8.7 Any notice or other document to be given shall be deemed to be properly given if left at or dispatched by prepaid post to the address of the party last known to the party giving notice and if so posted shall be deemed to have been given on the day following posting.
8.8 It is agreed that CUSafe’s sole obligation is to use its best endeavours to provide the customer with the monitoring of signals using the CUSafe application on “Smartphones” and Services specified in the Registration page.
8.9 Certain legislation such as the Trade Practices Act applies to Subscription period terms which cannot be excluded by agreement and where such terms apply it shall be read as if they were included.
8.10 In the event CUSafe breaches its obligations under the terms & conditions or “Registration Page” it agrees at its election to perform the relevant Services again. Its total liability under Terms & Conditions is to the extent permitted by law expressed in this sub-clause and it shall have no further or other liability to the customer whatsoever
